1. Agreement to Terms

These Terms of Service (‘Terms’) govern your access to and use of the Synthetica website located at synthetica.com.au (‘Website’) and your purchase of any products from Synthetica ABN [INSERT ABN] (‘Synthetica’, ‘we’, ‘us’, ‘our’).

By accessing the Website, creating an account, or placing an order, you confirm that:

• You are at least 18 years of age;
• You have read, understood, and agree to be bound by these Terms in their entirety;
• You are purchasing products solely for legitimate in vitro research, laboratory, or scientific study purposes;
• You are not purchasing products for personal use, human consumption, veterinary use, or any purpose not expressly permitted under these Terms;
• You have the legal capacity to enter into a binding contract under Australian law.

If you do not agree to these Terms, you must immediately cease using the Website and must not place any order.

2. Research Use Only — Critical Disclaimer

2.1 Synthetica sells research-grade peptide compounds exclusively for in vitro laboratory and scientific research purposes. Our products are not approved by the Therapeutic Goods Administration (TGA), the Food and Drug Administration (FDA), or any other regulatory authority for human or veterinary use.

2.2 By placing an order, you represent and warrant that:

• You are a qualified researcher, scientist, or laboratory professional, or are purchasing on behalf of a registered research institution or laboratory;
• You will use all products solely for legitimate scientific research or educational purposes in a properly equipped laboratory or research facility;
• You will not administer any product to any human being or animal under any circumstances;
• You will not resell any product purchased from Synthetica for use as a therapeutic, dietary supplement, or for human consumption;
• You understand that research peptides are experimental compounds and that their safety and efficacy in humans has not been established;
• You will comply with all applicable Australian laws, regulations, and institutional guidelines governing the use and handling of research chemicals.

2.3 Synthetica makes no representations or warranties that any product is safe, effective, or suitable for any human or veterinary application. Any use of Synthetica products outside the scope of legitimate in vitro research is entirely at the risk of the purchaser and is not condoned, authorised, or supported by Synthetica.

2.4 Synthetica expressly disclaims all liability for any harm, injury, illness, death, legal consequences, or other adverse outcomes arising from any use of its products outside of approved in vitro research contexts.

3. Age Restriction

3.1 You must be 18 years of age or older to access the Website or purchase any product. By checking the age verification box at entry or checkout, you confirm you are 18 or older.

3.2 Synthetica reserves the right to cancel any order and refuse service if we have reasonable grounds to believe the purchaser is under 18 years of age. No refund will be provided where an order is cancelled due to suspected underage purchase.

4. Product Information & Accuracy

4.1 Synthetica takes reasonable care to ensure product descriptions, purity specifications, and compound information are accurate at the time of publication. However, we do not warrant that any product description, purity claim, or other information on the Website is error-free, complete, or current.

4.2 Purity percentages are based on certificates of analysis from our suppliers and/or our own third-party testing. Results may vary between batches. Synthetica makes no guarantee that any specific batch will achieve exactly the stated purity percentage.

4.3 Product images are representative only. Actual products, packaging, and labels may differ from images shown.

4.4 Synthetica does not provide medical, legal, or scientific advice. Nothing on this Website constitutes advice of any kind. You should seek qualified professional advice before undertaking any research project.

5. Pricing & Payment

5.1 All prices displayed on the Website are in Australian Dollars (AUD) and include GST unless otherwise stated.

5.2 Synthetica reserves the right to change prices at any time without notice. Price changes will not apply to orders already confirmed.

5.3 By placing an order you authorise Synthetica to charge the payment method provided for the full order amount including any applicable shipping fees.

5.4 If your payment is declined or reversed, Synthetica reserves the right to cancel your order and pursue recovery of any amounts owed.

5.5 Synthetica uses third-party payment processors. Your payment information is not stored by Synthetica. By using our checkout you agree to the terms of the applicable payment processor.

6. Orders, Cancellations & Refunds

6.1 An order is only accepted and binding when Synthetica sends you an order confirmation email. We reserve the right to refuse or cancel any order at our discretion, including where:

• There is reasonable suspicion of fraudulent or deceptive conduct;
• A product is out of stock or no longer available;
• There has been a pricing or product description error;
• We have reasonable grounds to believe the order is not for legitimate research purposes.

6.2 Due to the nature of research peptides (temperature sensitivity, shelf life, and strict storage requirements), all sales are generally final. Synthetica will only accept returns or provide refunds in the following circumstances:

• The product delivered is materially different from what was ordered;
• The product arrives in a condition that is clearly damaged or compromised due to a fault in our packaging or dispatch process;
• Synthetica has made a manifest error in the order.

6.3 Any return or refund request must be submitted to support@synthetica.store within 7 days of delivery. You must provide photographic evidence of any damage or discrepancy. Synthetica will assess all claims within 5 business days.

6.4 Refunds will not be provided where the customer has changed their mind, made an error in their order, or where the product has been opened, stored incorrectly, or mishandled after delivery.

6.5 Your rights under the Australian Consumer Law (ACL) are not excluded by these Terms to the extent that they cannot legally be excluded.

7. Shipping & Delivery

7.1 Synthetica ships Australia-wide. We do not currently offer guaranteed international shipping due to customs and regulatory complexity.

7.2 Estimated delivery timeframes are provided as a guide only and are not guaranteed. Synthetica is not responsible for delays caused by Australia Post, couriers, natural disasters, or events beyond our reasonable control.

7.3 Risk of loss and title to products passes to the customer upon dispatch. Synthetica is not liable for products lost or damaged in transit after dispatch, however we will reasonably assist with lodging claims with carriers where appropriate.

7.4 You are responsible for ensuring your delivery address is correct. Synthetica is not responsible for non-delivery resulting from an incorrect address provided by the customer.

7.5 You are responsible for ensuring you can legally receive the products ordered at your delivery address under all applicable laws and regulations.

8. Intellectual Property

8.1 All content on the Website including text, images, logos, graphics, and design is owned by or licensed to Synthetica and is protected by Australian and international copyright law.

8.2 You may not reproduce, distribute, modify, or commercially exploit any content from this Website without prior written consent from Synthetica.

9. Limitation of Liability

9.1 To the maximum extent permitted by Australian law, Synthetica’s total liability to you for any claim arising from or related to these Terms, the Website, or any product purchased, is limited to the total amount paid by you for the relevant product in the 12 months preceding the claim.

9.2 Synthetica is not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profit, loss of data, personal injury, or death, whether arising in contract, tort, or otherwise.

9.3 Synthetica expressly excludes all liability for:

• Any harm, injury, illness, or death arising from misuse of products outside their stated research purpose;
• Any consequences arising from human or animal consumption of any product;
• Any legal, regulatory, or professional consequences arising from the purchaser’s use of products;
• The accuracy or completeness of any third-party research, studies, or publications referenced on the Website.

9.4 Nothing in these Terms excludes or limits liability that cannot be excluded under the Australian Consumer Law, including guarantees of acceptable quality and fitness for purpose where they apply.

10. Indemnity

You agree to indemnify, defend, and hold harmless Synthetica, its directors, officers, employees, contractors, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from:

• Your breach of these Terms;
• Your use of any product in a manner not expressly authorised by these Terms;
• Any misrepresentation made by you in connection with your purchase;
• Any third-party claim arising from your use or misuse of any product.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of New South Wales, Australia. You irrevocably submit to the exclusive jurisdiction of the courts of New South Wales in relation to any dispute arising under or in connection with these Terms.
